Welcome to One Koncept. These Terms of Service govern your use of our website, onekonceptoffer.com (the "Site"). Please read them carefully.

Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use the Site.

About One Koncept

One Koncept is a property investment and development company. We buy land for our residential and commercial development projects, including townhomes, apartments, multi-family homes, and commercial buildings. We work directly with property owners and make our offers in writing.

Use of This Site

This Site lets property owners who received an offer letter from One Koncept respond to it online. Using the Reference # on your letter, you can:

  • Let us know you are interested in selling for the offer amount on your letter
  • Submit a counter offer
  • Ask to be removed from our mailing list

You can also respond by phone or email using the contact information below.

Offers and Letters of Intent

  • Non-binding. Our offer letters and Letters of Intent are non-binding. Submitting a response on this Site, including accepting an offer or submitting a counter offer, does not create a binding contract for either party.
  • Purchase and Sale Agreement. A purchase becomes binding only when both parties sign a written Purchase and Sale Agreement, which will set out the specific terms, due diligence period, and closing timeline.
  • Counter offers. Any counter offer you submit is for One Koncept's consideration and is not guaranteed to be accepted.
  • Expiration. Offers are subject to the expiration date stated in your letter, unless extended by One Koncept.
  • Buyer. The acquiring entity will be a One Koncept affiliated or project-specific company named in the Purchase and Sale Agreement.

Your Responsibilities

  • Accurate information. You agree that the information you submit is accurate and that you are the owner of the property referenced in your letter, or are authorized to act for the owner.
  • No accounts. The Site does not require or allow you to create an account.
  • Lawful use. You agree to use the Site only for lawful purposes related to your property.

Prohibited Activities

You must not:

  • Violate any law or regulation
  • Submit false information or respond on behalf of a property you do not own or are not authorized to represent
  • Infringe on the intellectual property rights of others
  • Engage in fraudulent or deceptive practices
  • Upload or distribute viruses or any other harmful software, or attempt to interfere with the Site

SMS Terms

By checking the consent box on our form, you agree that One Koncept may contact you by phone, text message (SMS), or email about your property, including about your offer letter, your response or counter offer, and the next steps in a possible sale.

  • Consent. Consent to receive text messages is not a condition of selling your property to us or of using this website.
  • Message frequency. Message frequency varies based on your inquiry and our conversation with you.
  • Costs. Message and data rates may apply, depending on your mobile plan.
  • Opting out. You can opt out at any time by replying STOP. You will receive one message confirming you have been unsubscribed, and no further texts after that.
  • Help. Reply HELP for assistance, or contact us at [email protected] or 866-855-4272.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • Privacy. Your phone number and SMS consent are handled as described in our Privacy Policy.

Intellectual Property

All content on the Site, including text, logos, visual design, and trademarks, belongs to One Koncept or its licensors. Photos used on the Site are licensed from their owners. You may not copy or use our content without permission.

Feedback

If you send us feedback or suggestions, you agree that we may use them without compensation or credit to you.

Disclaimer and Limitation of Liability

The Site and its content are provided "as is" for general information. We do not guarantee that the Site will always be available or free of errors. To the fullest extent permitted by law, One Koncept is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. Nothing on the Site is legal, tax, or financial advice; you may wish to consult your own advisors before selling your property.

Changes to These Terms

We may update these Terms of Service at any time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted means you accept the updated terms.

Governing Law

These terms are governed by the laws of the United States and the laws of the state in which One Koncept is organized, without regard to conflict of law principles. Any Purchase and Sale Agreement will state the law that governs that transaction.

Termination

We may suspend or end your access to the Site at our discretion, including for any violation of these Terms of Service.
